- Par une décision du 10 mai 2012, la CJUE a décidé que la retenue à la source de 30% (25% antérieurement, voire 15% en application des conventions fiscales) prélevée par la France sur les dividendes versés à des OPCVM étrangers est contraire au droit de l'Union car elle instaure un régime fiscal différent pour les OPCVM résidents et non-résidents.
